  212. II.  Deregulation of Activities Reserved to the State
  213.  
  214. 1.   The activities set out in Section I are reserved to the
  215. Mexican State, and private equity investment is prohibited under
  216. Mexican Law. Where Mexico allows private investment to
  217. participate in such activities through service contracts,
  218. concessions, lending arrangements or any other type of
  219. contractual arrangement, such participation shall not be
  220. construed to affect the State's reservation of those activities.

  222. 2.   If Mexican laws or regulations are amended to allow private
  223. equity investment in an activity set out in Section I, Mexico may 
  224. impose restrictions on foreign investment

  232. participation notwithstanding Article 1102 and describe them in
  233. Annex I. Mexico may also impose derogations from 1102 on foreign
  234. equity investment participation when selling an asset or
  235. ownership interest in an  enterprise in activities set out in
  236. Section I and describe them in Annex I.

  239. III.  Activities Formerly Reserved to the Mexican State
  240.  
  241.      Where an activity was reserved to the Mexican State on
  242. January 1, 1992 and is not reserved to the Mexican State upon
  243. entry into force of this Agreement, Mexico may restrict the 
  244. initial sale of a state-owned asset or an ownership interest in a
  245. state enterprise that performs that activity to enterprises with
  246. majority ownership by Mexican nationals, as defined by the
  247. Mexican Constitution. For a period not to exceed three years from
  248. the initial sale, Mexico may restrict the transfer of such asset
  249. or ownership interest to other enterprises with majority
  250. ownership by  Mexican nationals, as defined by the Mexican
  251. Constitution.  Upon expiration of the three year period , the
  252. obligations of national treatment set out in Article 1102
  253. (National Treatment) shall apply. This provision is subject to
  254. Article  1108 (Reservations and exceptions).
